Overview:

- Please do not copy my photos or use them against any copyright laws

- The photos taken will be used in various media for advertising and in contests to the photographer's discretion, unless the client expresses their concern in writing 

- All photo sessions are guaranteed with one free photo session, if you are not pleased for any reason

- All product sales are final sale, no refunds or exchanges

 

 

 

Definitions

In these Terms and Conditions, "client" refers to any persons who may have requested the photographer's services, or who were included in the photos taken by the photographer. "Photographer" refers to Mariya, the original photographer booked by the clients, and any other photographer or videographer who was assisting Mariya in the photo sessions/events photographed.

 

Privacy

The photographer will never sell, trade, or give away the personal information of her clients. She will only post first names of photo subjects, unless requested not to.

 

The photographer has the right to request further information from potential or previous clients, as she sees appropriate, for clarification.

 

Copyright

The photographer holds the copyright to all photos taken by her.

 

The client holds printing rights on the images provided by the photographer on the complimentary disc. However, the client may not sell, modify, or enter the provided photos into contests without permission. Photos are for personal use only.

 

Photos posted anywhere on this website are not for public use. Please do not copy, print, or distribute them.

 

Image Use

The photographer is responsible for taking into consideration any requests clients may have regarding posting photos on the internet.

However, the photographer holds the right to post any photos taken, on this or other websites, as seems appropriate to her.

 

The photographer has the right to enter any photos taken by her into photo contests and sweepstakes without prior notice to clients.

 

The photographer has the right to use any photos taken by her, in any media, for promotional, and other materials.

 

Price

The photographer has the right to change posted prices for her services and products provided without prior notice.

 

Guarantee

The photographer provides a one-time guarantee on each photo session. If a client is displeased, another session, of lesser or equal value, will be booked for no fee to the client, up to a year from the first session.

 

Refunds/Exchanges

No refunds or exchanges are available on any products available for sale on this website. Clients may take advantage of the above-mentioned photo session guarantee, however no refunds will be provided for any photo sessions.

 

Liability

If the photographer is unable to perform due to any natural or unnatural disasters, or due to the photographer’s illness or injury, then the photographer shall return any deposit amount charged to the client to date, but shall receive the agreed upon payment in full, and shall have no further liability with respect to this agreement. This limitation on liability shall also apply in the event that any images are lost through equipment malfunction, lost in the mail, or otherwise lost or damaged due to unexpected causes. In the event that the photographer fails to perform to the expectations of the client for any reason, she shall not be liable for any amount in excess of the photographer’s deposit paid by the client to date.

 

Contests

The photographer reserves the right to disqualify individuals from contests or promotional deals without further explanation. She may terminate any contests and promotions on this website at any time.

 

 

These Terms and Conditions are subject to change at any time without prior notice to clients and/or contacts. Clients agree to all Terms and Conditions when they book a photo session with the photographer. Clients may terminate their agreement to Terms and Conditions by cancelling a photo session more than 24 hours prior to the booking, and not booking another session with the photographer.
